A new version of the Regulation "On the Procedures to be Applied in the Event of Disputes Over Domain Names" will come into force on November 18, 2024.
The Regulation "On the Procedures to be Applied in the Event of Disputes Over Domain Names" is a regulatory document ‒ an appendix to the Rules for Registering Domain Names in .RU and .РФ ‒ and regulates the relations of the parties in the event of disputes related to the violation of the rights of the copyright holder of a trademark (service mark) during the registration and use of second-level domain names in .RU and .РФ by domain name administrators.
The new version of the Regulation was approved by the decision of the General Meeting of Founders of the ANO "Coordination Center for the National Internet Domain" dated October 11, 2024 (Minutes of the Extraordinary General Meeting of Founders of the ANO Coordination Center for TLD .RU/.РФ No. 32 dated October 11, 2024).
The amendments to the Regulation are due to the need to bring the requirements of the Regulation into line with the requirements of the legislation of the Russian Federation. From the date of entry into force of Federal Law No. 193-FZ of June 28, 2022 "On Amendments to Part Four of the Civil Code of the Russian Federation", legal entities, individual entrepreneurs and individuals, including self-employed individuals, may be the owners of the exclusive right to a trademark. In this regard, provisions have been added to the new version of the regulatory document that relate to copyright holders - individuals.
