The Coordination Center interpreted the procedure for the suspension of delegated domain without the administrator’s consent

The Coordination Сenter for TLD RU made public clarifications regarding suspension of delegated domain without the Administrator’s consent. Suspension of delegation represents a procedure, according to which the Registrar “shuts down” the domain. As a rule, such an action requires the domain Administrator’s consent. Termination of delegation taken on a basis of the request of a law-enforcement agency, which exercises operational investigative actions, is an exception to the rule. In order to make the domain delegation termination procedure as transparent as possible the CC has developed special clarifications describing various options.

In particular, the request in writing from a law-enforcement agency should be substantiated; it should provide references to the allegedly illegal information posted on the “disputable” site. That said, a law-enforcement agency shall qualify the offence according to the RF Criminal Code or Administrative Offences Code. Moreover, the published procedures clarify that the law-enforcement agencies should first communicate their request to the hosting provider and where the latter failed to answer - to the Registrar.

It should be noted that such a request should not refer to the electronic media because the RF law provides for a special procedure of termination of such organizations’ operation. The CC’s clarifications also explain how to deal with social networks and third-level domains.

In order to restore the domain delegation in such cases, the administrator should state that the causes behind its suspension have been remedied. In the event the law-enforcement agency, which made the decision, agrees with the Administrator or does not respond to the Registrar’s request within 30 days, the domain delegation may be restored.
