Russian Internet users are discussing the draft Terms and conditions of domain names registration in domains .RU and .РФ. It is revealing that many people took the trouble to read the full text of the Terms and conditions and sent their comments on specific items. This means that the Terms and conditions, which will govern the domain space in Russia in the future, affect many people who are willing to spare their time and effort in order to improve Terms and conditions and contribute to their development.
All comments and suggestions have already been submitted to the ad-hock group, which is dealing with the new procedures and they surely will be taken into consideration while developing the final version of the text.
Many of those who sent us their comments are concerned that a section on domain names dispute resolution is missing in the Terms and conditions. Andrey Kolesnikov, the CC’s CEO, repeatedly highlighted the fact that the section on domain names dispute resolution had been temporarily removed from the Terms and conditions, although the respective section of domain names dispute resolution is present in the Terms and conditions in zone .RU, which for many years served as a basis for the forensic practice. However, an alarming reverse takeover trend emerged – namely, some seek registration of a trademark solely to take over the operable namesake domain. Therefore, the section required serious revision and the ad-hock group failed to reach a consensus on the section’s wording. It turned out that the law enforcement practice regarding domain name dispute resolution in our country emerged in a quite arbitrary manner, with one verdict on a case contravening another one rendered on an essentially similar case. Therefore, a new ad-hock group will be formed to develop this section. It will comprise practicing lawyers and experts who deal with intellectual property rights issues. Once the section is drafted and approved by all stakeholders, it will be incorporated in the Terms and conditions.
