Alibaba Failed First Domain Dispute After 44 Victories

World Intellectual Property Organization (WIPO) Panelist Kiyoshi Tsuruhas ruled on a complaint filed a UDRP against Alibaba.mx in Mexico's ccTLD. As you might guess, the complaint was filed by the Chinese company Alibaba, a giant in the online commerce market. The Respondent was the Mexican company Alibaba Alimentos Balanceados de Belleza, which produces feed and nutritional supplements for farm animals and is not known to everyone even in its own country.

The balance of power initially looked unequal. Moreover, Alibaba registered its trademark in Mexico in the fall of 2005, and the defendant only filed an application to register the trademark ALIBABA ALIMENTOS BALANCEADOS DE BALLEZA in 2023. However, the Chinese company was unable to provide any significant evidence of the main thing: that the domain was acquired or used to the detriment of its interests. At the moment, visitors who go to Alibaba.mx are greeted by a page with the Alibaba Alimentos Balanceados de Belleza logo and a notification that the company’s online store will soon launch here. And although the domain name is indeed identical to the name of the Alibaba trademark, the fact of illegal use of the domain name is more important for the Uniform Domain Dispute Resolution Policy. But it was never possible to install it. As a result, the complaint was left unsatisfied.

It should be noted that Alibaba very strictly monitors compliance with its rights in the domain space. As Domain Gang reports, previously, she had already filed complaints under the UDRP 44 times and achieved victory all 44 times,. But on the 45th case, this winning streak was interrupted.
