McCoy & Partners B.V. failed to get McCoy.com domain

The World Intellectual Property Organization (WIPO) Arbitration has ruled on a complaint filed under the UDRP against the McCoy.com domain name. The complaint was filed by the consulting company McCoy & Partners B.V. from the Netherlands. The company uses the mccoy-partners.com domain for its website, but probably felt that a shorter name without the hyphen would suit it better.

Observers from the very beginning indicated that it would be very difficult for the company to win this dispute, notes the Domain Name Wire resource. McCoy is a very common surname in the English-speaking world, and proving your right to it is a rather strange task. However, in an attempt to do so, McCoy & Partners B.V. resorted to quite perishing absurd arguments. In their complaint, they noted that the domain registrant did not respond to their repeated requests. The regular check of e-mail messages is the responsibility of the registrant, and the lack of a response may be considered a violation of the registration agreement.

The argument, perhaps, deserves to be entered into the records of the UDRP trials as one of the most ridiculous. By the way, the registrant of the McCoy.com domain did not respond to the notice of the UDRP trial either. But this did not affect the decision of WIPO arbitrator Adam Taylor. He noted that the domain was registered back in 2001, long before the emergence of McCoy & Partners B.V. This, and the fact that McCoy is a common surname, were more than sufficient grounds for dismissing the complaint.
