Take-Two Interactive, maker of a popular video game series Grand Theft Auto, could not prove their rights on GTA.tv domain. The complaint filed by Take-Two Interactive was considered and rejected by World Intellectual Property Organization (WIPO).
Domain GTA.tv (now inactive) belongs to iCity Corp. In their complaint video game developers indicated that they own all the rights to a GTA trademark. However representatives of the Respondent managed to prove that in their case GTA states for Greater Toronto Area. Earlier on iCity Corp created webpages gta411.com and gtanews.com, and they in fact are dedicated to different aspects of the life of Toronto and its suburbs.
WIPO jury recognized the arguments of the Respondent to be convincing enough and returned a verdict according to which this case has nothing to do with cybersquatting or abusive conduct regarding domains. Thus, domain GTA.tv remains at the disposal of iCity Corp.
