Two companies using the Del Monte trademark will be the first to use Legal Rights Objection procedure. One of the companies objects to the .delmonte gTLD, while another is applying for it.
The objection was posted by the World Intellectual Property Organization (WIPO). Fresh Del Monte Produce, Inc is the applicant for .delmonte, while the objecting company is Del Monte Corporation. Both are food companies and work in the fruit industry, but Fresh Del Monte has been working independently from Del Monte for over 20 years, and has a license to use the brand. It seems, however, that the license doesn't work over new gTLDs.
Legal Rights Objections is a procedure allowing trademark owners to challenge gTLD applications if they suspect a trademark infringement is taking place.
