James Bond could not stand up for himself

Arbitration Center of the World Intellectual Property Organization (WIPO) has declined the complaint against the CasinoRoyale.com domain name. The complaint was filed under the Uniform Domain Name Dispute Resolution Policy (UDRP) by London Operations LLC, which owns the intellectual property rights to the franchise featuring Agent 007 James Bond. The outcome of the case seemed to be predetermined: the Complainant is the holder of CASINO ROYALE trademarks associated with the famous novel and film about James Bond as well as other franchised entertainment projects and souvenir merchandise. As for the Respondent, Casino Royale Brand Ltd of Malta purchased the domain in December 2024 to launch an eGaming and crypto-integrated gambling platform.

However, all the James Bond’s glory as well as the financial and legal resources behind him were insufficient. WIPO arbitrators stated an obvious collision. On the one hand, Casino Royale is a well-known title of the book about James Bond and the relevant brand. On the other hand, the “casino royale” has an obvious meaning associated with casino and gambling. Moreover, the Respondent indicated that the name Casino Royale is also used by other companies, specifically by a casino in Las Vegas, Sint Maarten Island, and Royal Caribbean cruise ships.

According to Domain Gang, the proceedings were complicated by some additional circumstances: pending trademark filings, revocation actions against the Complainant’s EU and UK CASINO ROYALE marks, claims of prior negotiations, and conflicting evidence about the Respondent’s business plans and related parties.

Finally, the panel of three WIPO arbitrators arrived at a conclusion that the dispute goes far beyond an ordinary cybersquatting case. In the arbitrators’ estimate, the case concerns complicated factual and legal issues, which are more expedient to consider in court, where the parties will be able to disclose the evidence in full and discuss in detail their mutual claims regarding the trademarks. The complaint was dismissed without prejudice to the right to appeal. It means that the Complainant may file another complaint, should more facts appear in support of its position. So far, we have to state that James Bond was unable to achieve his goal.
